How to avoid penalties when dividing retirement assets

California couples who are ending their marriages may need to consider how their retirement accounts may be divided in the split. If those assets are not divided properly, it could result in negative consequences today and in the future. For instance, if one spouse is transferring a portion of his or her IRA to the other spouse, it needs to be done as an incident to divorce.

Social Security benefits after a divorce

Divorcees in Los Angeles might be surprised to find out that they are eligible to collect Social Security benefits based upon a former spouse's earnings records without engaging in any further dispute. Even after a subsequent marriage or decades of being single, these funds may be accessed assuming certain criteria are met by the claimant. Early knowledge of this can help with retirement planning and possibly impact asset division negotiations in an ongoing divorce.

In a high asset divorce, financial fraud is possible

If you are preparing for a divorce, you may be wondering how to plan for your life after the court divides your marital property. If you and your spouse have substantial assets, you may be expecting that your finances after the divorce will make your standard of living comfortable. However, this may not be the case if your spouse uses the time before property division to hide or dissipate your joint assets.

What happens when a restraining order is granted?

Some divorces and separations in California involve allegations of domestic violence. When one spouse is accusing the other spouse of violence or threats of violence, a court may agree to grant a domestic violence restraining order. A parent may petition the court for a restraining order to protect themselves as well as any minor children that they have.

Handling proposed moves with children after divorces

After some California couples divorce, one former spouse will want to move to be closer to a new partner who lives further away. When children are involved, the parent who wishes to move away may need to file a motion to relocate or negotiate with the other parent in order to try to secure an agreement.
