ustodial parents often disregard the impact of moving to a new location on their child(ren) or the other parent. Although a parent may feel that they have the right to move their child(ren) away from the other parent, many times legal and physical custody are not the only indicator of the parent’s right to move their child(ren) away from a noncustodial parent. Although a parent may not have sole legal or physical custody of their child(ren), that does not mean that they have given up their parenting or visitation rights. In fact, under California law, non-moving parents have a right to prevent the move if they feel it would be detrimental to their child(ren)’s best interest(s).
