Marital Settlement Agreements
The marital process is a unity through which property can be commingled. Such a commingling may make it difficult to tell what property belongs to whom. The Law Offices of Thomas & Associates assists clients in crafting the appropriate agreement to make clear what property belongs to whom. This can be done before marriage (a prenuptial agreement), during the marriage, or after the marriage (a post-marital agreement).

Prenuptial Agreements
A prenuptial agreement, or pre-nup, is an increasingly common device for protecting each party's separate property prior to entering into a marriage and any benefits that may accrue on such property during marriage. It is used by people of all asset levels to shield those assets from being used when dividing community property during divorce proceedings. People who have children from a prior marriage and property gained from a lifetime of work often use a prenuptial agreement to make sure their children benefit. To discuss the benefits of a prenuptial agreement, contact us.

We draft prenuptial agreements that stand up over time and that accomplish the goals of the client. A prenuptial agreement is strong protection for assets such as real property, investments, retirement accounts, and other separate property during property division. Once people are married, California family law governs what happens to their property. In the absence of a prenuptial agreement, married parties have far less control over how it is divided.

Marital Settlement Agreements
A Marital Settlement Agreement, is an efficient and less expensive way to end a marriage. This is whereby spouses create their own divorce settlements including custody and support issues, as well as property division. This path to a judgment for dissolution of marriage is usually less expensive and less stressful. There is usually no need to physically go to court, and the costs of filing fees and attorney fees are lower than a contested matter resulting in litigation.
When a couple wishes to end their marriage by using a post-marital agreement, it is advisable for both parties to have an attorney. Even if the marriage is ending amicably, someone needs to be protecting the interests of each person both at the time of the agreement and for the future. Once drafted, we always advise the opposing party to have the agreement reviewed by an attorney of his/her choosing to allow for equal representation of both parties in the agreement.
