Your Rights As a Debtor

Under federal law, you have debtor's rights. These rights, conferred by the Fair Debt Collection Practices Act and Fair Credit Reporting Act, allow your to stop harassment by creditors, and inaccurate credit reports.

The Fair Debt Collection Practices Act ("FDCPA")

Under this federal act, debt collectors must follow certain rules in collecting money from you and are prohibited from harassing you. If they fail to disclose the purpose of their communication to you, repeatedly call you, contact your employer, contact you at work when they know your employer prohibits your personal calls; call your neighbors or relatives, call at inappropriate times; or use threatening or obscene language when calling, they may be liable to pay statutory damages, actual damages and your attorneys' fees. In addition, if you send them a written request to stop calling or writing you, they must follow your request.

The Fair Credit Reporting Act ("FCRA")

If your credit report contains inaccurate or false information, you have the ability to request that the credit-reporting agency prove the accuracy of such information. If you are denied a loan or other financing, you may have the right to examine a free copy of your credit report.
